Furniture Warranty
Your new Maiden Home Furniture may be covered by a limited warranty (the “Furniture Warranty”). This Furniture Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
PRODUCTS COVERED BY FURNITURE WARRANTY
This Furniture Warranty extends to furniture, including all upholstered products (including, without limitation, sofas and chairs), and casegoods products (including, without limitation, benches, stools, tables, and chairs) (collectively, the “Furniture”), manufactured by Maiden Home, Inc. (“Maiden Home”) and purchased directly from Maiden Home. The Furniture Warranty does not cover products sold in “distressed” or “as is” condition, or products sold “second hand” or as “floor samples”. The Furniture Warranty is only valid in Maiden Home's Shipping Area (Contiguous 48 State and select parts of Canada as detailed on our website) and does not apply to any furniture which has been moved outside of the Shipping Area. The Furniture Warranty does not apply to pieces that are not able to be successfully delivered by Maiden Home’s drive team due to fit, or pieces that have been altered any way post-delivery.
This Furniture Warranty does not cover the following:
- Normal wear and tear or damage from daily use.
- Comfort preference.
- Physical abuse, damage or alteration to the structure and/or material of the Furniture, including but not limited to, dents, nicks, stains, or disassembly services; provided, that the Defect is caused by such abuse or damage.
- The fabric, leather, or any other material used to upholster furniture
- A normal softening and flattening of the cushion foam and fibers, which is considered normal wear.
- Damage to solid wood pieces as the result of misuse or mistreatment, including but not limited to exposing pieces to extreme temperature or humidity variation.
- Replacement of any non-defective pieces in the Furniture (for example, if you purchase furniture with multiple components and only one component is defective, then we will only replace the defective component).
- Any Furniture (whether manufactured by Maiden Home or not) sold by resellers who are not authorized retailers.
- Any Furniture that is reupholstered or repaired by any resource other than Maiden Home or third parties expressly authorized by Maiden Home.
In the event of a Defect, Maiden Home’s sole and exclusive liability and your sole remedy under this Furniture Warranty will be, at Maiden Home’s option, to repair the Furniture or provide a replacement Furniture product, subject to your fulfillment of “Your Responsibilities” below. Replacement Furniture may be provided in a fabric or finish different from the Furniture you originally purchased, depending on fabric and finish availability at the time of replacement.
WHO FURNITURE WARRANTY EXTENDS TO
The Furniture Warranty applies to you if (i) you purchased the Furniture from Maiden Home or an authorized reseller for normal residential purposes, (ii) if a professional trade member purchased the Furniture on your behalf from Maiden Home for normal residential purposes, or (iii) your Furniture will be used for a commercial use, and the Furniture was designed specifically for commercial use. Please retain a copy of your receipt as proof of purchase. All Maiden Home warranties are not transferable.
MAIDEN HOME’S OBLIGATIONS UNDER FURNITURE WARRANTY
Maiden Home warrants the Furniture in its original packaging sold to you against manufacturing defects (“Defects”) for the periods of time set forth below, depending on the nature of the Defect. Any implied warranties associated with the Furniture last for the same duration as the Furniture Warranty.
Lifetime Furniture Warranty
All frames and spring systems, including joints, bases, legs and hardware are under warranty to be free from Defects for the useful life of the product. Maiden Home will pay reasonable and customary labor rates to inspect the Furniture and validate any supposed Defects. Maiden Home will then pay reasonable and customary labor rates to repair or replace the defective parts (at Maiden Home’s sole discretion) at no charge to you.
2-Year Furniture Warranty
Chair swivels and glides, drawer glides, door hinges, sleeper mechanisms, table extensions, locks, and other mechanisms are under warranty to be free from Defects and against the loss of functionality for two (2) years from the date of purchase from Maiden Home or an authorized reseller, with validation of normal wear and tear and confirmation by Maiden Home of functionality loss.
YOUR RESPONSIBILITIES
In the event of a Defect and in order to get the benefit of this Furniture Warranty, you must contact Maiden Home and provide Maiden Home with proof of the original date of purchase. Evidence of a Defect and any claims must be sent to the address set forth at the end of this Furniture Warranty. Certain Defects may be repaired in your home with our authorization. Should shipping costs be required to return your Furniture, you will not be responsible for those costs. If you wish to replace your Furniture with a more expensive Furniture product (“Upgrade Furniture”), then please e-mail Maiden Home at the e-mail address set forth at the end of this Furniture Warranty. You will be required to pay the difference between the original purchase price of the Furniture and that of the Upgrade Furniture, plus the cost of any related additional system pieces necessary for such Upgrade Furniture.
Maiden Home will repair or replace (as applicable) your Furniture or Upgrade Furniture. Repairs will happen in your home.
Replaced or repaired Furniture that are not Upgrade Furniture are subject to the same Furniture Warranty and same duration of the Furniture Warranty as the original Furniture. For example, if you obtain a replaced or repaired Furniture that is the same style and price as the original Furniture, then the term of the Furniture Warranty replaced or repaired Furniture begins from the date of purchase of the original Furniture. If you purchase Upgrade Furniture, then you obtain a new Furniture Warranty, and the term of the Furniture Warranty for that Upgrade Furniture will begin upon the purchase of the Upgrade Furniture.
DISCLAIMER, LIMITATION ON LIABILITY
EXCEPT AS STATED IN THIS DOCUMENT, TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, THE FURNITURE IS PROVIDED “AS IS”. THIS FURNITURE WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES WITH RESPECT TO THE FURNITURE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS FURNITURE WARRANTY, IN NO EVENT WILL MAIDEN HOME OR ITS SUPPLIERS BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE FURNITURE OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF MAIDEN HOME HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. MAIDEN HOME’S TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE FURNITURE GIVING RISE TO SUCH LIABILITY.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
ARBITRATION
In the event a dispute arises between you and Maiden Home arising out of this Furniture Warranty, such dispute will be determined and settled by binding arbitration in the United States county in which you reside, or if there is no such county, then New York County, New York, in English, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. Notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction. For all purposes of these Terms, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in New York County, New York. Any arbitration under these Terms will take place on an individual basis: class arbitrations and class actions are not permitted. YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU AND MAIDEN HOME ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
You must seek arbitration for disputes arising out of this Furniture Warranty prior to exercising any rights or seeking any remedies created by the Title I of the Magnuson Moss Warranty Act. If you choose to pursue any rights and remedies that are not created by Title I of the Magnuson Moss Warranty Act, then arbitration is not required.
GOVERNING LAW
This Furniture Warranty will be governed by the laws of the State of New York.
